Default California e-discovery rules update

Thanks for the update, Skates. Do you think it's fair to assume that the bill will sail through the Legislature based on the strong support it received during the last legislative session? If it hadn't been for Schwarzenegger's position to veto nearly every bill that hit his desk last session (a political move), the bill would be law today.

Hi David:

Actually, you are correct about the politicization of the bill, however, that door swings both ways.

There are many reasons to be against the bill if you're an attorney. If the formal rules are not adopted, it's easier to avoid running afoul of the law. To put it simply, one can't violate a rule that doesn't exist.

In my travels, the people "in the know" who feed me info about this issue put the chances of passage at an aggregate of about 50/50.

AB 5 had its first reading in the Senate.

Default Action on AB 5?

This is a weird one. I received an automated notice that there was further action April 13th, but have been unable to verify what happened.

Here's what I've got so far...
